Globalvoice prepaid calling solutions and services (the “Services”) are products of the Norwegian limited liability company Globalvoice AS. By acknowledging these general terms and conditions (the “General Terms and Conditions”) by completing the registration process and clicking the “confirm” button you (the “User”) simultaneously acknowledge to adhere and comply with them as they at all times are presented at the Globalvoice applicable web-pages. Please read them carefully. Globalvoice AS may change these General Terms and Conditions or any charges, fees and other conditions relating to the Services from time to time at its sole discretion. Any modification shall be deemed effective as of their posting on the relevant Globalvoice website or by other means under section . User expressly agrees to be bound by any such modified terms and conditions or other instruction by Globalvoice.

1 The Services

The Services enable the User to make long distance or international phone calls. Details of the Services are disclosed at the relevant web-pages. User is responsible for being able to use the Services, and must hereunder:

  1. provide for User's own access to the World Wide Web and pay any service fees associated with such access, and
  2. ensure User has all equipment necessary to connect to the World Wide Web, including a computer and modem.
Globalvoice does due to its low-cost policy benefiting both User and Globalvoice not provide any assistance to the User, including any technical or customer support.

2 User’s specific obligations

User acknowledges, understands and agrees:

  1. To provide true, accurate, current and complete information when registering for or in relation to the Services. If any information provided by User is untrue, inaccurate, not current or incomplete. User shall not impersonate or create a false identity of any person.
  2. Globalvoice has the right to terminate User's account and refuse any and all current or future use of the Services by user without repayment. If all payment is complete Globalvoice can't terminate a User's account in less than one month.
  3. To be solely responsible for any and all charges incurred by User or persons using User’s identification or rights to the Services or any device related thereto including computers, software and fixed and cellular phones. Globalvoice is not responsible for unlawful use by third parties of User’s rights to the Services or said devices.
  4. To be solely responsible for all billing transactions. Billing transactions encompass sign-up transactions (purchases at the time of sign-up), purchase transactions (purchases that are not auto-recharge transactions which are made after sign-up) and auto-recharge transactions (purchases that are automatically made via Globalvoice's auto-recharge feature; this is additionally addressed below). Customer can pay for all such transactions via a credit card and/or debit card as specified on the Globalvoice web-pages.
  5. To have understood the following mechanism of the auto-recharge billing transactions: The auto-recharge option offers a convenient way to make sure you always have a minimum balance in your Globalvoice account. With it you can place phone calls at any time without having to recharge your card manually. Therefore, if you sign up for a Globalvoice account after the automatic recharge feature becomes available, said automatic recharge feature will be activated by default. This means that when your account balance runs below € 2,00, our system will automatically recharge your account credit card. An auto-recharge transaction will always be at least € 20. If the account balance at the time of the auto-recharge transaction is negative (or less than € 0,00), the total amount of the auto-recharge will be the sum of the amount needed to completely offset the negative account balance, plus € 20,00 (Example: A customer's account balance is € 2,00. The total amount after auto-recharge will be € 22,00.) The rechargeing will only be done once pr day. YOU CAN ALWAYS TURN OFF THIS FEATURE BY SIMPLY UNCHECKING THE AUTO-RECHARGE BOX UPON INITIAL SIGN UP, OR YOU MAY (I) LOG-IN TO YOUR GLOBALVOICE USER ACCOUNT AND DESELECT THIS FEATURE (II) EMAIL OR CALL A GLOBALVOICE CUSTOMER SERVICE REPRESENTATIVE TO CANCEL THIS FEATURE SETTING AT ANYTIME.
  6. to abide by all applicable local, state, national, and international laws and regulations in User's use of the Services. User agrees to be solely responsible for the contents of User's transmissions through the Services.
  7. not to transmit through the Services any unlawful, harassing libelous, privacy invading, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind.
  8. not to interfere with the use and enjoyment of the Services by any third party and not to interfere with, disrupt or gain unauthorized access to any Services or servers or network connected to the Services;
  9. to comply with all requirements, procedures, policies and regulations of networks connected to the Services as at all times appearing at the Globalvoice web-pages or otherwise informed;
  10. not to transmit "junk mail," "spam", "chain letters", or unsolicited mass distribution of commercial messages.

3 User/member account, password and security

User will receive a password and account designation upon completing the customer registration process. User is responsible for maintaining the confidentiality of the password and account, and is fully responsible for all activities that occur under User's password or account. All Globalvoice accounts have a 6-month expiration period. This expiration date will be extended for another 6 month period for each successful recharge so that the actual expiration date will always be 6 months from the date of the most recent successful recharge. User agrees to immediately notify Globalvoice at support@Globalvoice.no (or/and at other contact information provided at Globalvoice’s web-page) of any unauthorized use of User's password or account or any other breach of security. Globalvoice does not have any responsibility for unauthorized use of User's password or account or any other breach of security. In the event of unauthorized use of User's credit card, User must notify credit card provider immediately. Each user can see its calling value on the account page and under Balance. The cost of each call the user can see under History.

4 Final sales

There are no refunds and thus all sales are final unless there is an extended system wide outage of Services encompassing all of the following for at least one week: local access, toll-free access, domestic termination, and international termination, or other system failures as determined by Globalvoice at its sole discretion. All outgoing calls from user/customer using our system represent one or more local calls and thus will be charged from your account even if the call is not answered by the recipient or for other reason (such as incorrect number) does not reach the designated receiver. If you choose to delete your account there is no refund of your balance.

5 No Emergency Service

The Services may not under any circumstances be relied on for emergency calls, as the implied systems do not have the necessary reliance and will terminate under power failure, disruption, technical problems etc. Emergency calls must therefore be carried out through other telecommunication.

6 No right of resale

User agrees not to resell the Services or use of or access to the Services.

7 Duration of Services and Termination

User’s account will expire six (6) months from the date of your last successful account charge (or recharge). Globalvoice further reserves the right to deactivate your account and remove all other features and services if the account balance remains zero or negative for a period of ninety (90) days or more. User agrees that Globalvoice may terminate this agreement with User and thereby User's password, account and use of the Services if Globalvoice is of the opinion (documentation is not necessary) that User has violated or acted inconsistently with the letter or spirit of these General Terms and Conditions or that User has violated the rights of Globalvoice or other users or parties.

8 Purchase from advertisers

User's correspondence with or participation in any promotion of advertisers found on the Globalvoice-related web-pages, including payment and delivery of related goods and/or services, and any other terms, conditions, warranties or representations associated with such dealings are solely between User and such advertiser. User agrees not hold Globalvoice liable for any loss or damage of any kind incurred as the result of any such dealings.

9 Protection of property

User acknowledges and agrees that all material or immaterial rights such as (but not limited to) software, technical solutions, trademarks etc found at Globalvoice’s web-pages, being part of or related to the Services or being owned or used by Globalvoice’s partners is protected by law and that User may not use this for any other purpose than User’s use of the Services in accordance with the letter and spirit of these General Terms and Conditions. User expressly agrees that all intellectual property rights in the Services, the Globalvoice.no or other related website, any and/or all underlying systems, support platforms, ideas, business models and/or any other like or unlike items associated with the Services shall inure to the sole benefit of Globalvoice. User further agrees that he/she shall not reverse engineer, decompile and/or otherwise attempt to learn the underlying ideas, algorithms and/or any other such proprietary ideas, concepts, content and/or property nor shall User cause or permit any other party to do same.

10 Disclaimer of warranties

User expressly agrees that use of the Services is at member's sole risk. The Services is provided on an "AS IS" and "AS AVAILABLE" basis. Globalvoice and its partners expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Globalvoice makes no warranty that the Services will meet User's requirements, that the Services will be uninterrupted, timely, secure, or error free; nor does Globalvoice make any warranty as to the results that may be obtained from the use of the Services or as to the Services products will be corrected.

11 Indemnity and limitation of liability

User hereby agrees to indemnify and hold Globalvoice, and its subsidiaries, affiliates, officers, and employees, harmless from any claim or demands, including reasonable attorney's fee, made by any third party because of or arising out of User's use of the Services, User's connection to the Services, User's violation of this General Terms and Conditions, or User's violation of any right of a third person. User agrees that Globalvoice shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the Services or for cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through or from the Services, including but not limited to, damages for loss of profits, use, data or other intangible, even if Globalvoice has been advised of the possibility of such damages. User further agrees that Globalvoice shall not be liable for any damages arising from interruption, suspension or termination of Services, including but not limited to direct, indirect, incidental, special, consequential or exemplary damages, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

12 Notice to the User

Any notice to User, to the extent that Globalvoice determines in its sole discretion that such notice be disseminated, shall be made at the decision of Globalvoice and via Globalvoice’s web-pages or (still at the decision of Globalvoice) voice mail, mobile messaging and/or electronic mail.

13 Law and Courts. Interpretation

Globalvoice and the relationship between User and Globalvoice or any issue relating thereto or the Services shall be governed by the laws of the Kingdom of Norway and Oslo city court as the sole first venue. The failure of Globalvoice to exercise or enforce any right or provision of these General Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these General Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this license remain in full force and effect. User agrees that regardless of any statute of law to the contrary, any claim or cause of action arising out of or related to use of the Services or these General Terms and Conditions must be filed within one year after such claim or cause of action arose or be forever barred.

14 Technical information

So far the GVCall application does not work on mobile phones with Windows mobile. It might not work on other mobile phones as well. On the Globalvoice site and under Help, the User can see how to download and install the Globalvoice application GVCall. Under Help and “Click here to find your mobile phone” the User can see which mobile phones that has been tested, and that it works on. The User can also see where the application lies when installed.
